Национальный институт юстиции является публичным учреждением, ответственным за обучение кандидатов на должности судьи и прокурора, профессиональной подготовке действующих судей и прокуроров, начальное и непрерывное обучение секретарей судебного заседания, а также других лиц, содействующих отправлению правосудия.

Training of judges and prosecutors

The person who passed the admission exam is a candidate for the position of a judge or a prosecutor.

The training period for both the judges and prosecutors is of 18 months.
According to the NIJ Council Decision no.5 of 30.08.2007, candidates for the position of judge and prosecutor enrolled, employed when participating in the contest, submit original work books which are kept at NIJ during training. They receive a monthly scholarship worth 50% of the salary of the judge's function in court. Medical insurance may be purchased individually
Initial training for the position of judge or prosecutor is delivered according to the educational plan and the curriculum, approved by the NIJ Council, after coordination with the Superior Council of Magistracy and Prosecutor General’s Office.
Training takes place in 4 semesters:
  •    Semester I. Basic specialization and fundamental training.
  •    Semester II. Separated specialization of judges and prosecutors.
  •    Semester III. Practical internship.
  •    Semester IV. Applicative work
Initial training of candidates for the position of judge and prosecutor ends with graduation exams, consisting of theoretical and practical tests which help assess the knowledge level necessary for an in office judge and prosecutor.
Graduates, candidates the position of judge or prosecutor are obliged, based on the general average of certificates, to participate in the competition for filling the position of judge or prosecutor, in the manner prescribed by the Law on the Status of Judges, and the Law on the Prosecution, accordingly.
Graduates participating in the contest then choose, in descending order of general average obtained in graduation exams, from the available positions of judge or prosecutor accordingly.
Graduates who have won the contest for filling the positions of judge and prosecutor are required to participate for 3 years after graduating the Institute. As the term expires, the graduate can not enter the contest based on the general average shown in the certificate.
Should a graduate, due to unfounded reasons, not participate in the contest for filling the judge or prosecutor positions, the Institute Council may request the refund of the scholarship awarded during training.

Admission

The admission to the initial training is organized for individuals who intend to become a judge or prosecutor. The total number of vacancies is approved on a yearly basis.

The admission competition is organized, annually, by the Council of the Institute, in full compliance with the transparency and equality principles.

Any Moldovan citizen, having permanent domicile in Moldova who complies with the conditions provided by the law for the positions of a judge or prosecutor is entitled to participate at admission competition. The candidate should be a legally capable person, has university degree in law, clean criminal record and integrity. Another mandatory condition for the candidate is to be fluent in Romanian language. In addition, the candidate should be capable for the relevant position, from a medical perspective.

The competition is organized as follows:  

  • Submission of the documents.
  • Written exam: I phase (elimination psychological test) and II phase (specialization test).
  • Verbal exam.
  • Approval of the results of admission competition.

Training of Trainers

The activity of training of trainers is focused on practical and theoretical education of professors through the use of modern didactics technologies, modern interactive and participative educational techniques and informational technologies and represents one of the key competences of the NIJ as provided by the Statutes of the National Institute of Justice, approved at the meeting of the Council of the NIJ of 6 June 2007.

Continuous training

The continuous training of the beneficiaries of the National Institute of Justice is one of its key competences and represents professional high quality training of judges, prosecutors and other stakeholders in the area of justice necessary for the increase of the efficiency, independency and integrity of the justice system of the Republic of Moldova.

The NIJ organizes the continuous training courses for the following categories of the beneficiaries:

Initial training

The initial training of the individuals acting in the justice system, for the first time in the Republic of Moldova, has been performed by the National Institute of Justice.  

The initial training is the training of the individuals having university degree, being, where applicable, a precondition for their appointment to the position of a judge or prosecutor.  

The beneficiaries of the initial training are the candidates to the position of a judge or prosecutor.

О НИЮ

Национальный институт юстиции (НИЮ) был создан 9 ноября 2007 г. Согласно Закону о Национальном институте юстиции, принятому Парламентом Республики Молдова 8 июня 2006 г., НИЮ является публичным учреждением, располагает собственным имуществом, а также административной, научно и преподавательской автономией.

НИЮ осуществляет начальное обучение кандидатов на должности судьи и прокурора, непрерывное обучение действующих судей и прокуроров, секретарей судебного заседания, помощников судей, начальников секретариатов судебных инстанций, консультантов прокуроров, советников по пробации, адвокатов, предоставляющих юридическую помощь, гарантируемую государством, а также начальное и непрерывное обучение других лиц, действующих в сфере юстиции, в предусмотренных законодательством случаях.

НИЮ был создан в качестве ценного фактора процесса продвижения правового государства в Республике Молдова. НИЮ выступает за независимость, прозрачность и эффективность национального правосудия.

Веб-страница Национального института юстиции, разработанная при поддержке ПРООН, посредством предоставляемой информации обеспечивает публичность деятельности НИЮ, а также процесса начального и непрерывного обучения судей и прокуроров, вовлеченных в процесс отправления правосудия и защиты прав человека.
