On Friday, 10 October 2025, the National Institute of Justice hosted a training session entitled “Theoretical and Practical Aspects of Assessing an Anti-Competitive Agreement and an Abuse of Dominant Position Practice”.
The event was opened by the Director of the National Institute of Justice, Ramona Strugariu, the President of the Competition Council of the Republic of Moldova, Alexei Gherțescu, and the Resident Twinning Adviser, Cristina Butacu.
The training activity, designed for judges, prosecutors, and representatives of the Competition Council, was conducted by Ionel Florea, Judge at the Administrative and Fiscal Litigation Section of the High Court of Cassation and Justice of Romania, and Cătălina Pântea, Deputy Director of the Legal Assistance and Litigation Directorate within the Competition Council of Romania.
During the session, the experts discussed relevant aspects of European case law on the application of Articles 101 and 102 of the Treaty on the Functioning of the European Union, presenting general principles of interpretation and representative cases adjudicated by Romanian courts, as well as significant findings of the Constitutional Court. The discussions also covered situations involving undertakings that facilitate anti-competitive practices, along with key elements in identifying and sanctioning abuse of dominant position.
The event was organized within the framework of the Twinning Project “Strengthening the Institutional Capacity of the Competition Council for the Enforcement of Competition and State Aid Policy in Line with EU Best Practices”, funded by the European Union and implemented in partnership with the competition authorities of Romania, Lithuania, and Poland.
