Freedom of assembly and association through European Court`s of Human Rights case-law: a public lecture performed by Mrs. Diana Sarcu, judge at the ECtHR

NIJ trainees, who were recently enlisted in the initial training program, had the opportunity to take part at the public lecture performed by Mrs. Diana Sarcu, the national judge at the European Court of Human Rights. The event was organized on October 27, 2022, at the National Institute of Justice and had a debate on the actual topic: freedom of assembly and association through European Court`s of Human Rights case-law.

Within two hours, were discussed with real examples from the ECtHR case law, subjects related to  issues on article 11 from the Convention such as: its applicability in relation to other rights regulated by the ECHR, the importance of the right to freedom of peaceful assembly and interference with the right to freedom of expression, meeting as a form of expression and expression of opinion during the meeting, positive obligations of the state, as well as restriction of the right to freedom of assembly and interference with the exercise of this right, etc.

During the event, future judges and prosecutors have asked questions about the functioning of the Court, being particularly interested in the dynamics of requests to the ECtHR, statistics on applications, including pending and impactful applications, the duration of the case examination and others.

On Friday, October 28, 2022, the judge of the Republic of Moldova at the ECtHR, Diana Sarcu, held public lecture “Freedom of assembly and association through European Court`s of Human Rights case-law” and for the magistrates and judicial assistants of the Supreme Court of Justice.
