Romania's experience in legal writing and reasoning: public lesson held by Gabriela Scutea, EU High Legal Advisor on Justice and Prosecution

„Legal writing and reasoning: profile presentation” was the generic of the public lesson held by the EU High Legal Advisor on Justice and Prosecution of the Ministry of Justice, ex-General Prosecutor of Romania, Gabriela Scutea. The event took place on Thursday, March 21, 2024, at the National Institute of Justice, attended by the NIJ trainees of the initial training course, promotion of 2023-2025.

In the opening, Adrian Cerbu, ad Interim Director of the NIJ, a seconded judge, expressed his conviction on the importance of the discussed topic: „We, the judges and prosecutors speak through our judgments and ordinances, therefore, they must be written on the understanding of the citizen. Clarity of legal reasoning when drafting court documents is essential to increase public confidence in the judicial system”.

During the public lesson, Gabriela Scutea referred to her experience as a prosecutor and the challenges in her professional activity, relevant aspects of writing and legal argumentation with a main focus on judicial practice in Romania have been addressed. Thus, it was mentioned the need for consistent application of quality standards in the prosecutors activity and strengthening the capacity of analysis and synthesis for a consistent reporting to the values of the rule of law. Practical references to relevant procedural acts have also been made.
